Welcome to GiGS! ("we", "our" or "the application"). Your privacy is important to us. This summarized list of conditions and responsibilities is designed to help you understand how we collect, use, share, and protect your personal data when you use our mobile application and associated services ("Services"). By registering and using our Services, you are accepting the terms and conditions of this Privacy Policy.
1. Information We Collect
We collect the following personal information when you register and use our application::
Emails and Account Data: We use your email address to create and manage your account, send you important notifications, and provide you with secure access to our application. In addition, we collect account data to ensure the security and authenticity of transactions and activities on our platform.
Contact and Payment Data: We may request your postal address for informational purposes for users of the platform. If you decide to use services or features that require payment, we will collect the necessary payment information to process transactions securely. We do not store credit card information or any other means of payment directly in our application.

4. Event Booking Fees (only applicable to bands)
When you book an event through our application, you will be subject to a service fee. This fee will be automatically applied to each booking you make. The service fee is €3.99 per booking.
5. Acceptable Use
You agree to use our application responsibly and in accordance with all applicable laws and regulations. You must not use our application for illegal or inappropriate purposes.
6. Cancellation and Refunds
Cancellation and refund policies for events booked through our application will be determined by the individual event organizers. We recommend that you review the specific cancellation policies of each event before making a booking.
7. Payout Conditions
For events with paid tickets, the platform may delay payouts until the event is verified. Events will be considered verified if (a) at least one ticket was scanned using the official in-app scanner, and (b) no user disputes are filed within 24 hours of event end. If either condition is not met, the platform reserves the right to delay or cancel payouts pending review.
8. Prohibited Uses
You agree to use the application responsibly and in accordance with all applicable laws and regulations. You must not use the application in any of the following ways::
For illegal or inappropriate purposes as established by federal, state, local, or international law.
To exploit or harm minors in any way.
To send, receive, upload, download, or reuse any material that does not comply with the content standards set forth in these Terms of Use.
To send any advertising or promotional material without our prior written consent.
To impersonate the company, a company employee, another user, or any other person or entity.
To interfere with the use or enjoyment of the application by any person.
To disable, overload, damage, or impair the application or interfere with its use by third parties.
To use any device, automatic process, or means to access the application without our prior written consent.
To interfere with the proper functioning of the application.
To introduce viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
9. User Responsibility
You are solely responsible for all activities on your account. You must not share your login information or use other users' information. Please notify us of any unauthorized use of your account.:
GiGS! is an online platform that acts as a mere intermediary between venues, bands, and attendees of musical events. Therefore, the application is not the owner or manager of the events held through the platform, nor is it part of the internal management that may occur between its users.
As an online platform, GiGS! cannot be held responsible for the content provided by users or illicit activities in the application as long as it does not have effective knowledge of it or, after having it, acts quickly to remove or block access to said content.
By selling tickets for an event for a set price, the user is entering into a sales contract with another user and, therefore, will have to face the resulting tax obligations on their part.
Those users with a professional character who act in the development of their business activity as a seller, are responsible for complying with all applicable legal and tax obligations. Among them:
Issue and send the corresponding invoice to users.
Comply with those tax obligations derived from their status as a taxpayer of the Value Added Tax (VAT).
Comply with all obligations set forth in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.
10. Accuracy of Information
The information and content presented on the website and application are available for the sole purpose of being general information. We do not guarantee its accuracy, truthfulness, or usefulness. The website and application use content provided by third parties, with all permissions granted for its public use.:
Third-Party Content: We use third-party content in our application, including, but not limited to, LottieFiles and FlatIcon, with all the necessary permissions for its public use.
11. Disclaimer of Warranties
You understand that we cannot and do not guarantee that files available for download from the internet or the application will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of lost data.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE APPLICATION OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APPLICATION OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
12. Changes to the Terms of Service
We reserve the right to update or modify these Terms of Service at any time without prior notice. The modifications will take effect immediately upon their publication in the application. It is your responsibility to periodically review these Terms of Service to be aware of updates. Continued use of the application after the publication of modifications constitutes acceptance of said modifications.
