Welcome to GiGS! ("we", "our" or "the application"). Your privacy is important to us. This summarized list of conditions and responsibilities is designed to help you understand how we collect, use, share, and protect your personal data when you use our mobile application and associated services ("Services"). By registering and using our Services, you are accepting the terms and conditions of this Privacy Policy.

Terms and Conditions1. Identification of the Parties and Purpose
This document regulates the use of the GiGS! application and platform, operated by Art&Food d.o.o., with OIB 78489691764 and registered office at Pera Rudenjaka, 8. 20000 - Dubrovnik, Croatia.
By registering, creating an account, or using the Application, you accept these Terms and Conditions in full and without reservation. If you do not agree with any of the clauses, you must refrain from using the platform.
GiGS! acts exclusively as an intermediary technological platform that facilitates contact, date booking, and contracting between venues, bands (hereinafter, 'Promoters'), and attendees of musical events.
2. Account Creation and Eligibility
The use of GiGS! is restricted to individuals aged 18 or older. You agree to provide accurate, truthful, and updated information when registering.
You are solely responsible for all activities that occur under your account. You must not share your access credentials or use another user's account. It is your obligation to notify us immediately of any unauthorized use or security breach of your account.
3. Fees and Platform Commissions
GiGS! receives revenue for the technological and mediation services provided on the platform under two modalities:
3.1 Event Booking Fee (Applicable only to Bands): When a band books an event through our application, it will be subject to a service fee of €3.99 per booking, which will be applied automatically.
3.2 Ticket Sale Commission: For ticketed events, the Promoter sets the net amount they wish to receive for each ticket. GiGS! adds a service commission that is transparently shown to the buyer before completing the purchase. The final price paid by the attendee includes this commission.
3.3 Invoicing: GiGS! will issue the corresponding invoice to the Promoter only for the amount of service commissions or booking fees applied. The Promoter is solely and exclusively responsible for issuing the invoice, ticket, or simplified ticket to the attendee for the total amount of the ticket.
4. Payment Conditions, Stripe Connect, and Event Verification
GiGS! uses the secure payment gateway Stripe Connect to process all financial transactions.
Payment processing services for Promoters on GiGS! are provided by Stripe and are subject to the Stripe Connected Account Agreement. By operating as a Promoter on the platform, you agree to be bound by these Stripe terms.
For ticketed events, the platform will delay payouts until the event is verified and finalized.
An event will be considered verified and successfully finalized if: (a) at least one ticket has been scanned with the official GiGS! app scanner, and (b) no disputes or claims are presented by users within 24 calendar hours following the theoretical end of the event.
If any of these conditions are not met, GiGS! reserves the right to delay, freeze, or cancel payments after a manual review and communication with the parties.
In the event of payment disputes, chargebacks, or forced claims initiated by buyers through their banks, GiGS! reserves the right to withhold or deduct the amounts from any pending payment to the Promoter. If the funds have already been transferred, the Promoter agrees to refund GiGS! such amounts.
5. Cancellation, Refunds, and Exclusion of the Right of Withdrawal
Refund policies are governed by the nature of leisure events and the direct responsibility of the organizer.
In accordance with consumer protection legislation (Art. 103.l of the General Consumer Law in Spain and equivalent EU regulations), the 14-day right of withdrawal does not apply to leisure services with a specific execution date. Therefore, the purchase of tickets is final and no refunds will be admitted for the mere withdrawal of the buyer.
Ordinary cancellation and refund policies will be determined by the organizers (Promoters) of each event. GiGS! recommends reviewing these policies before purchasing.
In the event of cancellation of the event by the organizer, refunds must be managed in accordance with their established policy and applicable legislation.
If GiGS! cancels the event due to detection of fraud, illegal impersonation, or serious breach of these terms before the event is executed, the application will proceed to fully refund all affected parties.
GiGS! will not be responsible for cancellations, modifications, or interruptions of events caused by circumstances of force majeure outside its reasonable control, including adverse weather conditions, public authority decisions, health emergencies, or strikes.
6. Acceptable and Prohibited Use of the Application
You agree to use our application responsibly and in accordance with all applicable laws and regulations.
It is strictly forbidden to upload, share, or distribute illegal, harmful, pornographic, violent, harassing, hate speech, or discriminatory content. Likewise, you agree to treat other users with courtesy and respect.
You must not use the application to: exploit minors, send unauthorized advertising (spam), impersonate GiGS!, its employees, or other users, introduce viruses or malware, or interfere with the proper functioning or enjoyment of the app by other users.
7. User Responsibility and Platform Role
GiGS! is an online platform and acts as a mere technological intermediary between venues, bands, and attendees.
GiGS! is not the owner, manager, or organizer of the published events, nor is it part of their internal management. The ticket sales contract is perfected solely and exclusively between the Promoter and the buyer.
GiGS! cannot be held responsible for the content provided by users or illegal activities in the application, provided that it does not have actual knowledge of it or, upon having it, acts quickly to remove or block access to such content.
The Promoter is solely responsible for determining, declaring, and paying any applicable tax derived from the sale of tickets or the organization of the event (including VAT or local taxes), as well as complying with consumer defense regulations.
8. Veracity of Information and Intellectual Property
The information presented in the app is available for general information purposes only and relies on content provided by third parties.
We do not guarantee the accuracy, truthfulness, or complete utility of the information filled in by users on the platform.
GiGS! uses resources and content from third parties in its interface, including, but not limited to, LottieFiles and FlatIcon, having all necessary permissions for their public use according to their respective licenses.
9. Disclaimer of Warranties
We cannot ensure that files available for download from the application will be 100% free of viruses.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGS! WILL NOT BE LIABLE FOR LOSSES OR DAMAGES CAUSED BY DISTRIBUTED DENIAL OF SERVICE (DDoS) ATTACKS, VIRUSES, OR OTHER HARMFUL MATERIAL THAT MAY INFECT YOUR EQUIPMENT DUE TO THE USE OF THE APPLICATION.
GiGS! does not guarantee that the application will be available uninterruptedly. Access may be temporarily suspended for technical maintenance or updates. GiGS! will not be liable for economic losses derived from these temporary interruptions.
10. Account Deletion and Data Erasure
If you request that your GiGS! account be closed, it will immediately become inaccessible.
All data associated with your account, except those required by legal or tax obligations, will be completely deleted or anonymized within 14 calendar days following the date of the request.
During this process: (a) All events created or booked as a venue/hall will be canceled immediately; (b) Tickets purchased by other users for those canceled events will be automatically refunded; (c) Tickets you have purchased to attend other events will remain valid and you will be able to access them through the confirmation email received at the time of purchase.
11. Resolution of Disputes and Applicable Law
These Terms are governed by and construed in accordance with the laws of the Republic of Croatia.
In the event of disputes or incidents, users are recommended to first contact GiGS! at info@gigsismusic.com to seek an amicable solution.
If not resolved by amicable means, the parties submit to the jurisdiction of the competent courts of the city of Dubrovnik, Croatia, unless mandatory consumer protection legislation establishes another specific jurisdiction.
12. Modifications and Contact
We reserve the right to update these Conditions of Service at any time. Continued use of the app after changes are posted constitutes your acceptance.

Account Data: Email address, encrypted passwords, and data necessary to guarantee the security and authenticity of transactions.
Contact and Payment Data: We may request your postal address for information and invoicing purposes. If you use payment services, our provider Stripe will collect the necessary information. GiGS! does not store credit card information directly on its servers.
Usage Data: IP address, activity logs, and interactions within the application for security purposes and service improvement.
3. Purpose and Legal Basis for Processing
We process your data under the following legal bases:
For the execution of the contract: Account creation, booking management, ticket validation via scanner, and payment processing.
For compliance with legal obligations: Fraud prevention, invoicing, and requirements from authorities.
For legitimate interest: Sending important service notifications and maintaining network security.
4. Sharing Information
We do not share your personal information with third parties, except in the following necessary cases:
With our payment provider Stripe to process transactions securely.
With the Promoter of an event for which you have purchased a ticket, for the sole purpose of allowing access control and security.
When necessary to comply with applicable laws, regulations, legal processes, or governmental requests.
5. Data Retention and Erasure
We retain your data as long as your account is active.
If you request the deletion of your account, the associated data will be completely deleted or anonymized within 14 calendar days, except those that we are legally obliged to keep for audits or tax compliance.
6. User Rights
In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, delete, limit, or object to the processing of your data, as well as the right to portability.

7. Information Security
We take strict measures to protect your personal information and guarantee its confidentiality. We use industry-standard security practices and encryption technologies (such as SSL/TLS protocols) to protect your data against unauthorized access.
8. Changes to the Privacy Policy
We may update these policies in the future. We will notify you of any important changes by sending a notification to your registered email address.
